Terms of sale:
1. The selection process runs until 28.09.2025
2. At the end of the tender process, the vehicle will be sold to the highest bidder.
3. The purchase contract will be concluded with the interested party who makes the highest offer, which is subject to the approval of the creditors' committee and the insolvency administrator. The subject of the sale is a taxable transaction from the point of view of VAT. The seller sets a deadline for payment of the entire purchase price within 30 days from the approval of the creditors' committee and the insolvency administrator with the achieved purchase price, to account no. 2600240023/5800, variable symbol 25036114.
4. Interested parties are obliged to submit their offers by email to the intermediary's address: bajkai@tircentrum.cz and at the same time send a copy to the seller's email address: info@azaminsolvence.cz. Offers that are not submitted in copy to the seller will not be taken into account.
5. The subject of sale is sold and transferred as it stands and lies (in summary) within the meaning of Section 1918 of the Civil Code, if such a sale is possible under applicable legal regulations with regard to the nature of the monetized property, and the buyer is obliged to accept the takeover of the property in such condition. This information will be stated in the purchase contract.
6. The Buyer shall be obliged to take over the subject of sale upon the Seller's request within the specified period, with the risk of damage passing on the date of takeover, however, if the Buyer is late with the takeover, the risk of damage shall pass to the Buyer upon expiry of the period specified in the takeover; the costs associated with the takeover shall be borne solely by the Buyer;
7. The Buyer does not have the right to specify any property of the object of sale; the Seller shall not bear any responsibility for the condition of the object of sale and shall not guarantee that the Buyer will be able to use the object of sale for the purpose intended by the Buyer;
8. The Seller does not assume any guarantee for any properties of the subject of sale and liability for defects in the subject of sale is excluded (limited) to the full extent to which the legal system of the Czech Republic allows such exclusion (limitation);
9. The buyer waives in advance any rights arising from defective performance, in particular the right to request repair, replacement of the item or a discount on the purchase price or the right to withdraw from the contract, all within the meaning of Section 1916, paragraph 2 of the Civil Code.
10. The purchase contract will only be signed after the full purchase price has been paid.
